济南市住房和城乡建设局 关于济南市房屋建筑和燃气、供热工程项目 实施招标文件预公示的通知

各区县住房城乡建设局，济南新旧动能转换起步区管委会建设管理部、济南高新区管委会建设管理部、市南部山区规划发展局，各有关单位：
为进一步优化招标投标领域营商环境，规范招标投标市场行为，强化社会监督，切实保障投标活动的公开、公平、公正和开放竞争，按照《关于严格执行招标投标法规制度进一步规范招标投标主体行为的若干意见》（发改法规规〔2022〕1117号）鼓励建立依法必须招标项目招标文件公示或公开制度要求，现将实施招标文件预公示有关事项通知如下。
一、招标文件预公示适用范围
本市行政区域内依法必须公开招标的房屋建筑和燃气、供热工程项目。
二、招标文件预公示内容
招标人(或其委托的招标代理机构)应按市建设行政主管部门编制的招标文件示范文本格式编制招标文件。在招标文件正式发布前进行预公示，公示内容包括招标人（或其委托的招标代理机构招标代理）联系方式、招标内容、投标人资格条件、资格预审文件（若有）、招标控制价、评标办法、合同专用条款等。有关重大项目、重点项目的建设单位应提前充分考虑预公示所需的时间，确保项目顺利加快推进。
三、招标文件预公示流程
（一）招标人(或其委托的招标代理机构)在正式发布招标文件前，先登陆济南公共资源交易中心网站，点击“企业主体登陆”，进入“建设工程入口”，点击“招标文件预公示”菜单上传招标文件并填报有关信息，提交后推送至济南公共资源交易中心网站招标文件预公示信息栏目公示，招标文件预公示时间不少于3日。
（二）预公示期内,社会公众或潜在投标人均可通过济南公共资源交易中心网站招标文件预公示信息栏目，针对招标文件是否存在违反法律法规规定的情形，向招标人（或其委托的招标代理机构）提出意见及依据，并留下具体联系人的姓名和联系电话。
（三）预公示期满后，招标人应自行参考社会公众或潜在投标人提出的意见修改完善招标文件。对合理的意见应予以采纳，对不予以采纳的意见，应注明合理理由，预公示意见采纳情况（注：系统自动生成统一表格）作为招投标活动电子档案材料留存。
四、建立招标文件公平竞争审查机制。
鼓励招标人参照《公平竞争审查制度实施细则》（国市监反垄规〔2021〕2号），在招标文件预公示前，对招标文件进行公平竞争审查。
五、实施时间
本通知自2022年11月1日起实施。
