Management method

 

Chapter I General Provisions

Article 1 In order to further promote the construction of production safety standardization, give full play to the leading role of the creation of demonstration activities to enhance the essential safety level of building construction, according to the "Opinions of the CPC Central Committee and State Council on Promoting the Reform and Development of the Field of Production Safety", "Shandong Province Production Safety Regulations", "Interim Measures for Assessment of Production Safety Standardization in Building Construction", and the national and provincial requirements on production safety, combined with the actual situation of the province, to formulate this Measures.

Article 2 The building construction referred to in these measures refers to the construction of housing construction and municipal infrastructure projects.

Article 3 The Provincial Department of Housing and Urban-Rural Development is responsible for the unified management of the provincial construction safety and civilization standardization site (hereinafter referred to as the provincial safety and civilization site).

The housing and urban-rural construction department of the municipalities is responsible for the application, cultivation, verification and data submission of the provincial safe and civilized construction sites in the region.

Article 4 The provincial safe and civilized construction site is declared and cultivated according to the principle of "voluntary enterprise, dynamic management, whole process cultivation, fairness and impartiality", and no fee is charged.

Chapter II. Cultivation conditions

Article 5 Projects applying to cultivate safe and civilized construction sites in the province shall meet the following scale standards:

(1) Where the same construction unit constructs a housing construction project with an area of more than 20,000 square meters, a decoration and decoration project with a cost of more than 20 million yuan and a construction period of more than 3 months, and a municipal infrastructure project with a cost of more than 50 million yuan and a construction period of more than 3 months;

(2) Where two or more construction units jointly declare, the area of housing construction projects is more than 100,000 square meters, and the cost of municipal infrastructure projects is more than 150 million yuan;

(3) The scale of the project does not meet the above provisions, but the results of the standardization of construction safety production are particularly outstanding, or there are representative landmark projects.

Article 6 Projects applying for the cultivation of safe and civilized construction sites in the province shall meet the following conditions:

(1) The scale of project construction meets the requirements of Article 5, and the project information has been entered into the province's engineering quality and safety information supervision system;

(2) Obtaining construction permits, handling construction safety supervision procedures, and carrying out safety supervision by housing and urban-rural construction departments at the county level or above;

(3) Prepare a plan for the establishment of safe and civilized construction sites in the province.

Chapter III. Application and Incubation

Article 7 Within 30 working days after completing the formalities for construction permit (construction safety supervision), the construction unit shall submit an application for cultivation to the competent municipal department.

The municipal competent department shall complete the review within 15 working days after receiving the application materials. Those that meet the provisions of Articles 5 and 6 shall be listed as cultivation targets and reported to the Provincial Department of Housing and Urban-Rural Development.

Article 8 For projects listed as cultivation objects, the "Shandong Province Safety and Civilization Standard Chemical Land Cultivation Publicity Board" (see annex) shall be set up in a conspicuous position outside the entrance and exit of the construction site, and relevant information and supervision telephone numbers shall be announced to the public, and the whole process shall be subject to social supervision.

Article 9: The municipal competent departments shall, in conjunction with routine supervision and standardized evaluation work, guide the provincial safe and civilized construction site cultivation targets, and raise the level of standardization of construction safety and civilization.

Article 10 In any of the following circumstances, the cultivation qualification shall be revoked for a project included in the cultivation target:

(1) Construction safety liability accidents or other serious adverse events occur;

(2) Receiving administrative punishments from relevant departments for issues such as production safety, civilized construction, dust prevention and control, and epidemic prevention and control;

(3) There are potential safety hazards at the construction site, refusal to rectify or failure to rectify in place;

(4) Failing to carry out standardized self-assessments in accordance with provisions or committing fraud;

(5) Failing to pay migrant workers' wages in accordance with provisions;

(6) Failing to prepare a construction waste disposal plan in accordance with law or dumping, scattering, or piling up construction waste without authorization;

(7) There are other violations of laws and regulations or negative conduct.

Article 11 For projects listed as cultivation objects, the construction unit shall apply to the competent department of the municipality where the project is located for verification of the provincial safe and civilized construction site during the period when 50% to 80% of the project quantity is completed.

The competent municipal department shall conduct on-site verification of the cultivation objects applying for verification, and submit them to the Provincial Department of Housing and Urban-Rural Development for review if the following conditions are met:

(1) Meet the requirements of Articles 5 and 6;

(2) Carry out standardized evaluations of production safety in accordance with provisions, with complete and effective materials, and the competent departments have reached an "excellent" grade for the phased evaluation of the project;

(3) Have a high level in terms of safe production, civilized construction, construction of dual prevention systems, construction of smart construction sites, prevention and control of construction dust, epidemic prevention and control, application of advanced technology, creation of safety construction methods, formulation of safety standards, and source control of construction waste;

(4) All parties participating in the construction abide by the law and regulations, and have good credit;

(5) There are no circumstances listed in Article 10.

Article 12 When the competent municipal department submits a request to the Provincial Department of Housing and Urban-Rural Development for review, it shall submit the following materials:

(1) The complete set of materials formed during verification by the competent municipal departments in accordance with Article 11;

(2) Application for cultivation of engineering projects and plans for cultivation measures;

(3) Image materials formed during the review application and creation of the project;

(4) Other materials to be submitted.

Article 13 The provincial safe and civilized construction sites are divided into two grades: "standard chemical site" and "demonstration site", and "demonstration site" is better than "standard chemical site".

Article 14 The provincial safe and civilized construction site shall review and determine from the cultivation objects whose construction project safety production standardization assessment conclusion is "excellent".

After verification, the competent municipal department shall submit those who meet the requirements to the Provincial Department of Housing and Urban-Rural Development for review and confirmation. The Provincial Department of Housing and Urban-Rural Development organized experts to conduct on-site review, standard chemical sites were randomly inspected at a rate of 10%, and demonstration sites were all inspected.

Implementation rules and evaluation standards shall be formulated separately.

Article 15 After the Provincial Department of Housing and Urban-Rural Development reviews and confirms qualified cultivation targets, after the termination of project safety supervision, the project construction safety production standardization evaluation conclusion is "excellent", it shall be publicized through the official website of the Provincial Department of Housing and Urban-Rural Development and accept social supervision.

If there is no objection to the announcement, the Provincial Department of Housing and Urban-Rural Development shall announce it as a provincial safety and civilization standardization demonstration site or a provincial safety and civilization standard chemical site, and no certificate will be issued.

Chapter IV: Supervision and Management

Article 16 The competent municipal departments shall encourage construction enterprises under construction in their respective areas to actively apply for the cultivation of safe and civilized construction sites in the province, and increase the intensity of guidance. The situation of safe and civilized construction sites in the province will be used as the reference basis for the annual assessment of safety production work in various places.

Article 17 For those announced as provincial safe and civilized construction sites, the construction unit shall, in accordance with relevant provisions and contractual agreements, implement incentive measures such as incentives for excellence.

Article 18: The competent departments for housing and urban-rural construction at all levels shall include units participating in the construction of safe and civilized construction sites in the province into the credit management of the construction market, implement differentiated supervision, and encourage them to participate in various evaluations and awards in the field of engineering construction.

Article 19: Where the application for review is not made in accordance with provisions or the on-site review by the competent provincial or municipal departments is unqualified, the qualification for cultivating safe and civilized construction sites in the province shall be revoked.

Article 20: Where the circumstances provided for in Article 10 of these Measures are found to be a project that has been announced as a provincial safe and civilized construction site, the competent municipal department shall request the Provincial Department of Housing and Urban-Rural Development to revoke it, include it in the record of negative conduct in accordance with provisions and publicly expose it.

Chapter V Supplementary Provisions

Article 21: These Measures shall take effect on January 1, 2023 and shall be valid until December 31, 2027.
