《山东省建设工程造价管理办法》政策解读
2024年1月4日，新修订的《山东省建设工程造价管理办法》（以下简称《办法》）以省政府令第357号公布。现就有关情况解读如下：
一、《办法》修订的必要性
《山东省建设工程造价管理办法》自2012年以省政府令第252号颁布实施以来，在加强建设项目投资控制、规范市场主体计价行为、保障工程质量安全、维护市场经济秩序方面发挥了积极作用。但随着市场经济体制的不断完善和“放管服”改革的不断深化，需要对《办法》做出修订。
一是工程建设项目审批制度改革的需求。山东省人民政府办公厅2018年9月26日发布《山东省工程建设项目审批制度改革行动方案》，提出进一步精简审批环节，竣工结算文件不再作为工程竣工验收备案的条件等要求。为与各项改革措施衔接对应，需要对《办法》规定的各类备案事项做出相应调整。二是“证照分离”改革的需求。国务院2021年5月19日发布《关于深化“证照分离”改革进一步激发市场主体发展活力的通知》，取消工程造价咨询企业资质审批，要求创新和完善工程造价咨询监管方式，加强事中事后监管。《办法》中现有对造价咨询企业资质方面的要求，应当进行修改。三是工程造价市场化改革的需求。住房城乡建设部办公厅2020年7月24日发布《关于印发工程造价改革工作方案的通知》，提出改革工程计价模式，逐步停止发布预算定额，利用大数据、人工智能等信息化技术为概预算编制提供依据，全面推行施工过程结算和支付。《办法》中对计价规则、计价依据、结算方式的规定，已经不能完全适应造价改革的要求，应当进行充实完善。
二、《办法》修订的依据
《办法》主要依据了《中华人民共和国民法典》《中华人民共和国建筑法》《中华人民共和国招标投标法实施条例》《建筑工程施工发包与承包计价管理办法》《工程造价咨询企业管理办法》《注册造价工程师管理办法》《国务院关于深化“证照分离”改革进一步激发市场主体发展活力的通知》《住房和城乡建设部办公厅关于取消工程造价咨询企业资质审批加强事中事后监管的通知》《住房和城乡建设部办公厅关于印发工程造价改革工作方案的通知》《财政部 住房和城乡建设部关于完善建设工程价款结算有关办法的通知》《山东省人民政府办公厅关于印发山东省工程建设项目审批制度改革行动方案的通知》法律法规和制度规定。
三、《办法》主要修订内容
《办法》共七章四十四条，主要包括总则、造价计价依据、造价计价确定、从业管理、监督检查、法律责任、附则等方面内容，主要修订内容如下。
（一）关于各部门监督管理责任。按照省物价局2016年6月23日《关于明确<山东省定价目录>有关事项的通知》中放开工程造价咨询服务收费价格的要求，在《办法》中删除价格行政主管部门工程造价监督管理的职责。
（二）关于部分行政审批事项。按照“放管服”改革和工程建设项目审批制度改革要求，删除竣工结算文件备案作为竣工备案必备文件的要求，对各类备案事项统一执行上级部门规章，不再另行规定，删除工程造价计价软件应当经主管部门鉴定合格方可销售使用的要求，同时删除对应的罚则。
（三）关于造价咨询企业资质。按照国家“证照分离”改革要求，删除对于工程造价咨询企业资质许可、执业印章、分支机构设立等要求，增加对工程造价咨询企业能力、造价工程师的要求。
（四）关于工程造价改革。按照国家和省工程造价改革要求，修改工程造价计价依据和计价活动的组成内容，修改对合理工期确定和调整的要求，增加对工程造价计价计算机软件规范化、标准化的要求，增加工程造价应当体现市场决定性作用的内容，增加工程总承包模式下的计价管理规定。
（五）关于施工过程结算。按照国家和省推行施工过程结算的要求，增加施工过程结算的专门条款，规定发承包双方应当以时间节点或者进度节点对已完成工程量进行价款计算、确认，并按照合同约定比例支付，对于经确认的施工过程结算文件，工程竣工后不再重复审核。
（六）关于禁止行为和法律责任。对照上级部门规章已经规定的禁止行为、法律责任等情形，作了衔接规定。
此外，根据机构改革和部门职责调整划转的情况，对《办法》中有关部门的名称进行了统一规范，并对个别文字作了相应调整。
