住房和城乡建设部办公厅关于 建设工程企业资质有关事宜的通知

各省、自治区住房和城乡建设厅，直辖市住房和城乡建设（管）委，北京市规划和自然资源委，新疆生产建设兵团住房和城乡建设局，国务院有关部门建设司（局），中央军委后勤保障部军事设施建设局，国资委管理的中央企业：
为认真落实《国务院关于深化“证照分离”改革进一步激发市场主体发展活力的通知》（国发〔2021〕7号）要求，进一步优化建筑市场营商环境，减轻企业负担，激发市场主体活力，现将有关事项通知如下：
一、我部核发的工程勘察、工程设计、建筑业企业、工程监理企业资质，资质证书有效期于2023年12月30日前期满的，统一延期至2023年12月31日。上述资质有效期将在全国建筑市场监管公共服务平台自动延期，企业无需换领资质证书，原资质证书仍可用于工程招标投标等活动。
企业通过合并、跨省变更事项取得有效期1年资质证书的，不适用上款规定，企业应在1年资质证书有效期届满前，按相关规定申请重新核定。
地方各级住房和城乡建设主管部门核发的工程勘察、工程设计、建筑业企业、工程监理企业资质，资质延续有关政策由各省级住房和城乡建设主管部门确定，相关企业资质证书信息应及时报送至全国建筑市场监管公共服务平台。
二、具有法人资格的企业可直接申请施工总承包、专业承包二级资质。企业按照新申请或增项提交相关材料，企业资产、技术负责人需满足《建筑业企业资质标准》（建市〔2014〕159号）规定的相应类别二级资质标准要求，其他指标需满足相应类别三级资质标准要求。
持有施工总承包、专业承包三级资质的企业，可按照现行二级资质标准要求申请升级，也可按照上述要求直接申请二级资质。
